As an extension of the actual Form of electronic monitoring, our concept will provide a permanent monitoring of the offender via GPS and GSM. Our solution consists of a Two Tier System, which is constructed solely with openSource and other free software packages. The monitoring is coordinated trough a central server application, which communicates with the monitored client systems trough SMS-Messages. For location determination, a combination of GPS- and GSM is used. The inhomogeneous federal circumstances should be harmonized in order to implement a solution for whole Switzerland. The partaking in the monitoring program is voluntary, but data protection must be kept, as well as possible. Switzerland will enter the Schengen/Dublin II Agreement at the earliest in 2008. From then on, the Schengener Information System (SIS) and Eurodac must be in service. Electronic monitoring will have most impact in the field of positive situational crime prevention, by re-socialising the delinquents. The principle of proportionality may better be kept through the implementation of this kind of penal system. The cantons make savings on Jail expenses because of the lesser expenses on the electronic monitoring. But the penal system including ?work of public utility? is definitely more profitable. It is a proven fact that electronic monitoring has punishment characteristics. Concerns about total supervision during the field test, turned out to be mostly ungrounded. But with our enhanced system, the problem will be more serious. Furthermore, the caretaking is most important with the electronic monitoring system, otherwise, the achieved success in the field test can not be reached again.
